Know Your RightsAs a client, you have a right to be informed at all times concerning your case. If you are injured as a result of another person's negligence, under the law you are entitled to be compensated for your special damages (out-of–pocket expenses) past and future, and for your general damages (pain and suffering) so long as it is established the other person was negligent and the negligence is the cause of your damages. In select cases, such as some elder abuse actions, the injured party is entitled to recover attorney’s fees and costs if a certain burden of proof is met. Elder abuse litigation is governed primarily by laws passed by the State Legislature in 1986 and 1992. It was the intention of our representatives to encourage attorneys to prosecute elder abuse cases as this class of people, both the elderly (anyone over 65) and dependant adults (persons ages 18 to 65), need increased protection. If you were injured while in the course and scope of your employment, then you have a right to receive workers' compensation benefits. If the injury is in part the fault of a third party, someone other than your employer, we can assist you in pursuing a civil action against the third party.
